1. About these terms

These Terms of Service (“Terms”) apply to your use of www.3dmeta.com.au (the “Website”) and to every order you place with 3D META Pty Ltd (ABN 73 698 972 271) (“3D META”, “we”, “us”, “our”). Our Shipping Policy, Returns & Refunds Policy and Privacy Policy form part of these Terms. By using the Website or placing an order you agree to these Terms. If you do not agree, please do not use the Website.

We may update these Terms from time to time. The version published on the Website at the time you place an order is the version that applies to that order.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

2. Who can order

You must be at least 18 years old to place an order. If you are under 18 you may use the Website only with the involvement of a parent or guardian, who is responsible for any order placed. By placing an order you confirm that the information you provide is accurate and that you are authorised to use the payment method you select.

3. Your account

You can shop as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account. Let us know straight away at info@3dmeta.com.au if you think your account has been accessed without your permission. We may suspend or close accounts that are used in breach of these Terms or for suspected fraud.

4. Products, pricing and availability

We do our best to describe our products accurately and to show colours faithfully, but screens vary and filament colours may appear slightly different in person and between batches. Specifications, weights and print settings are provided as a guide.

Prices on the Website are shown in Australian dollars and include GST for Australian orders. Unless stated otherwise at checkout, prices shown in New Zealand dollars for New Zealand customers exclude any New Zealand GST, duties and customs charges, which are payable by you if they apply. Shipping is calculated and shown at checkout before you pay.

We may change prices, products and promotions at any time without notice, but changes will not affect an order we have already accepted. All products are subject to availability. If we discover a pricing or description error affecting an order you have placed, we will contact you and give you the choice of proceeding at the correct price or cancelling for a full refund.

5. Placing an order

When you place an order you are making an offer to buy the products at the price shown. The order confirmation email we send automatically is an acknowledgement that we have received your order, not an acceptance of it. We accept your order, and a contract for those products is formed, when we dispatch it (or, for pickup orders, when we tell you it is ready for collection). We may refuse or cancel an order before then, including where a product is unavailable, we cannot verify your payment or details, we suspect fraud or a breach of these Terms, or the order appears to be for resale without a trade account. If we cancel an order we will refund any amount you have paid in full.

We may limit quantities per order or per customer, for example during restocks or promotions. If you need larger quantities, contact us about a trade account.

You can ask to change or cancel an order by emailing info@3dmeta.com.au. We can usually help if the order has not been dispatched; once it has left our warehouse, our Returns & Refunds Policy applies.

6. Preorders and backorders

Products marked as preorder or backorder are not in stock when you order them. The estimated shipping date shown on the product page and in your order confirmation is our best estimate and may change if our shipment is delayed; we will tell you if it does. Preorders are charged in full at the time you order unless the product page says otherwise. You can cancel a preorder for a full refund at any time before it is dispatched. Any preorder discount applies only to the preorder items and cannot be combined with other discount codes unless we say so.

7. Payment

We accept Visa, Mastercard, American Express, PayPal, Shop Pay, Apple Pay, Google Pay, Afterpay, Zip and direct bank deposit. Payment is taken when you place your order. Afterpay and Zip are provided by those companies under their own terms and eligibility rules. Orders paid by bank deposit are dispatched once the funds have cleared in our account; if payment has not been received within 5 business days we may cancel the order.

8. Shipping and delivery

Delivery is governed by our Shipping Policy. Delivery times are estimates. Ownership of the products passes to you when we receive full payment, and risk in the products passes to you when they are delivered to the address you gave us (or, if you have given the carrier authority to leave, when they are left at that address).

9. Returns, refunds and consumer guarantees

Our Returns & Refunds Policy sets out our 14-day change-of-mind returns and how we handle faulty, damaged or incorrect items.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

10. Warranties

3D printers sold by 3D META come with a manufacturer’s warranty of at least 12 months from the date of purchase, in addition to your consumer guarantees. Warranty claims should be made to us at info@3dmeta.com.au and we will coordinate the claim with the manufacturer. Warranties generally do not cover damage caused by misuse, accidents, modifications, use of incompatible parts or materials, or normal wear of consumable parts such as nozzles, build surfaces and belts.

11. Using 3D printing products safely

3D printers, filament, resin and related chemicals must be used in accordance with the manufacturer’s instructions and the safety data sheets we publish on the Website. In particular: operate printers in a well-ventilated area and never leave them running unattended for long periods; keep printers, hot components and materials away from children and pets; wear gloves and eye protection when handling resin and isopropyl alcohol; and dispose of waste responsibly. Print results depend on your printer, settings and environment. Any technical advice we give is general guidance based on our experience and is provided in good faith; it does not replace the manufacturer’s documentation. To the extent permitted by law, we are not responsible for loss or damage caused by failing to follow product instructions or safety guidance.

12. Promotions, discount codes and giveaways

Discount codes must be applied at checkout and cannot be applied after an order is placed. Unless a promotion says otherwise, only one discount code can be used per order, codes cannot be combined, and codes do not apply to gift cards or shipping. Giveaways and competitions are subject to the terms published with that promotion. We may withdraw or change a promotion at any time, but this will not affect an order already placed.

13. Resellers and wholesale customers

The Website and these Terms are for retail customers buying for their own use or their own business. Resellers, retailers and distributors must hold a 3D META trade account, and wholesale orders are governed by our separate trade terms, which prevail over these Terms to the extent of any inconsistency. Products bought through the retail Website must not be marketed as authorised 3D META stock or sold as if by an authorised reseller without our written agreement. 14. Reviews and content you send us

We love seeing what you print. If you post a review, comment, photo or other content on the Website, tag us on social media or send content to us, you confirm that it is your own, that it is honest and based on your genuine experience, and that it does not infringe anyone else’s rights or contain anything unlawful or offensive. You keep ownership of your content, but you allow us to use, reproduce, edit and display it in connection with our business — on the Website, in our marketing and on social media — for as long as we like and without payment or attribution. If you would like us to stop using something you have shared, email us and we will remove it from the places we control. We may remove content that breaches these Terms and are not obliged to publish every review.

15. Intellectual property and acceptable use

The Website and its content — including the 3D META name and logo, product names, photographs, text, guides, print profiles and design — are owned by or licensed to 3D META and are protected by copyright and trade mark law. You may view and print pages for your personal use or to help you buy from us. You must not copy, reproduce or use our content for commercial purposes, use our name or logo without permission, scrape or harvest data from the Website, interfere with its security or operation, or use it for any unlawful purpose.

16. Third-party links and marketplaces

The Website may link to third-party websites (for example manufacturer sites, community resources and payment providers). We are not responsible for their content or practices. Orders placed through a marketplace such as eBay or JB Hi-Fi Marketplace are also subject to that marketplace’s terms.

17. Liability

To the extent permitted by law, and other than as set out in the Australian Consumer Law guarantees described above, we are not liable for any indirect or consequential loss, including loss of profit, business or data, arising from your use of the Website or our products. Where our liability for breach of a consumer guarantee can lawfully be limited (which does not apply to goods normally bought for personal, domestic or household use), it is limited, at our option, to replacing the goods or paying the cost of replacing them, or repairing the goods or paying the cost of having them repaired. Nothing in these Terms limits our liability for death, personal injury, fraud or anything else that cannot be limited by law.

18. Privacy

We handle your personal information in accordance with our Privacy Policy.

19. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If you have a problem with an order or the Website, please contact us first at info@3dmeta.com.au — we resolve almost every issue directly. You may also contact Consumer Affairs Victoria (or, in New Zealand, Consumer Protection at consumerprotection.govt.nz) or your local consumer protection agency at any time.

20. General

If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. If we do not enforce a right under these Terms, that is not a waiver of it. We are not liable for delay or failure to perform caused by events beyond our reasonable control, such as carrier disruptions, supplier delays, natural disasters or government action, but we will keep you informed and you may cancel an undelivered order for a full refund if the delay is substantial. We may transfer our rights and obligations under these Terms to another business if we sell or restructure our business.
